Terms and conditions
Last updated: 24 October 2026
1. Scope
These terms apply to all contracts between Kim Daniel Geisthardt, Kim Daniel Geisthardt Web Development, Dörffelstraße 12, 08527 Plauen, Germany (“provider”) and customers for Envbay services. Customers can be consumers (§ 13 BGB) or businesses (§ 14 BGB). Deviating terms of the customer do not apply unless the provider agrees in writing.
2. Service
The provider makes a private, hosted Envoryx instance available to the customer for development and staging, within the limits of the chosen plan (Free as a free trial under section 4a, Starter, Team or Agency; projects, users, storage, runtimes and features as shown on the pricing page at the time of order). The servers are located in the EU. The service is not intended for production use or production workloads. Envoryx is an open source project by a third party; the provider operates it as a hosted service.
3. Conclusion of contract
The presentation of the plans in the shop (my.envbay.com) is not a binding offer. By completing the order process (“order with obligation to pay”), the customer submits a binding offer. The contract is concluded when the provider confirms the order by email or provisions the instance. Before submitting, the customer can review and correct the entries in the order process. Contract languages are German and English. The provider stores the order data; the customer receives it with the confirmation email and finds orders and invoices in the customer account. These terms are available on this website at any time.
4. Beta
While Envbay is in beta, there is no guaranteed availability. Features and limits may change. During the beta, half the price applies for the first 6 months of the term, as stated in the offer; the regular price then applies automatically. During the beta, too, the provider is liable only as set out in section 13.
4a. Free trial (Free)
The “Free” plan is a free trial. It lasts 7 days from the provisioning of the trial instance. The customer can extend it once by another 7 days; the customer triggers the extension themselves in the customer account on the instance’s page.
The trial instance is limited to 1 CPU core, 1 GB of memory, 10 GB of storage and 1 project; the runtimes are those of the Starter plan. Branch environments, custom images and project backups are not included.
Notwithstanding section 10, the provider backs up a trial instance locally only: there are instance backups on the same server (the last three), but no offsite backup and no project backups. If the server fails, data of the trial instance may be lost irretrievably. The customer backs up important data themselves.
During the trial there is no entitlement to a particular availability, to restoration of data or to support response times. The provider may limit the number of trial instances operated at the same time; there is no entitlement to a trial instance being provisioned.
One trial instance is possible per customer (customer account). The customer may not circumvent this limit through further accounts or details; the provider may refuse or delete further trial instances.
When the trial ends, or, if it was extended, when the extended trial ends, the provider stops the trial instance. The instance and its data are then kept for 14 days. During this time the customer can extend the trial, if they have not yet done so, or keep the instance by upgrading to Starter, Team or Agency; on an upgrade all data is kept. The upgrade is an order under section 3, and sections 5 and 6 apply to it from that point on. Without an upgrade, the provider deletes the trial instance with all data and backups 14 days after the trial ends. Access to the data after the end of the trial is not owed; the customer exports their data beforehand. The provider notifies the customer by email of the approaching end, the expiry and the deletion; there is no entitlement to these notices.
Ordering and using the Free plan does not create a contractual relationship with an obligation to pay. A contract for a fee is concluded only by ordering a paid plan, including by way of an upgrade. Sections 5 and 6 do not apply to the trial, which ends without termination. The customer can end it at any time by email to support@envbay.com.
Section 8 also applies to the trial. In case of abuse, in particular a breach of the limit of one trial instance or a use prohibited under section 8, the provider may suspend and delete the trial instance immediately, without granting the customer the period under section 8, paragraph 2. Section 13 applies to liability.
5. Prices and payment
All prices are final prices in EUR and include statutory VAT of 19%. Payment is made monthly or annually in advance at the start of each term; with annual payment the price equals 10 monthly prices. Additional options (add-ons) are charged as shown on the pricing page. Billing runs through the shop. The payment method is currently PayPal; further payment methods (expected to be Stripe) may be added. The customer receives the invoice by email and in the customer account. The amount is due on ordering and at the start of each renewal. In case of late payment, the statutory provisions apply.
6. Term and termination
The contract runs for the chosen term (one month or one year) and renews each time for the same term unless it is terminated. Termination is possible for the end of the current term: for a monthly term, up to the last day of the current term; for an annual term, up to 14 days before its end. For consumers: after the first annual term, the contract continues for an indefinite period and can be terminated with one month’s notice to the end of a month.
Termination can be made through the customer account or by email to support@envbay.com. The right to terminate for good cause remains unaffected. In the customer account, the customer can also declare termination with the option “Cancel immediately”; the provider then shuts the instance down immediately. The termination nevertheless ends the contract at the earliest possible date under the first paragraph; the payment obligation for the current term remains, and the customer’s statutory rights, in particular the right of withdrawal, remain unaffected.
After the contract ends, the provider locks the instance and shuts it down, and on “Cancel immediately” does so at once. The instance and its data are deleted 14 days after the shutdown; backups are deleted no later than 30 days after the shutdown (section 10); everything no later than 60 days after the contract ends. Access to the data after the shutdown is not owed. The customer exports their data beforehand.
7. Customer duties
The customer keeps credentials secret, is responsible for the content and projects in the instance, and ensures their security (updates, passwords, access). The customer does not use the service for unlawful content. The customer ensures that the details in the customer account are correct and notifies changes without delay.
8. Acceptable use and abuse
The customer may use the instance only for development and staging of their own projects. In particular, the following are prohibited: attacks on third parties, mass mailing, cryptocurrency mining, scanning of third-party systems, distribution of malware and circumventing the isolation between instances.
On concrete suspicion of abuse, the provider may stop the instance immediately (a snapshot is retained) and will inform the customer. If abuse recurs, or if the customer does not remedy it within 7 days, the provider may terminate the contract.
To maintain the security of the platform, the files of customer projects are automatically checked for malware (see the privacy policy). The customer is responsible for the security of their projects; the provider is not liable for damage within the instance caused by the customer’s projects. Abuse reports go to support@envbay.com.
9. Suspension
The provider may also suspend an instance in case of non-payment after requesting payment from the customer in text form, setting a deadline. Data is retained during the suspension. The suspension is lifted as soon as the reason no longer applies. The customer’s obligation to pay continues during the suspension. Section 8 remains unaffected.
10. Data backup
The provider creates a daily encrypted backup of the instance settings (accounts, settings, project list) and keeps the last seven on a separate storage in the EU. For the free trial, section 4a applies. Project data (files and databases) is backed up only if the customer sets up a backup schedule in the project; the last three (Starter) or five (Team, Agency) backups per project are then kept. These backups serve to restore the platform and are no guarantee that specific data is available; restoring individual data is not owed. Backups of a terminated instance are deleted under section 6. The customer is responsible for their own exports and copies of their data; backups do not replace the customer’s version control.
11. Availability and support
The provider strives for trouble-free operation. No particular availability is guaranteed; during the beta this applies expressly. The provider announces maintenance where possible. Support is provided by ticket or email on working days in German and English. Response targets are stated on the pricing page and are targets, not guarantees.
12. Price changes
The provider may change prices for future terms. The provider notifies the customer in text form at least six weeks before the end of the current term. The customer can terminate the contract until the end of the current term; without termination, the new price applies to the following term. The price does not change for terms already paid. The end of the beta price after 6 months is not a price change within the meaning of this section.
13. Liability
The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where the provider has given a guarantee. For slightly negligent breach of essential contractual obligations (obligations whose fulfilment is necessary for the proper performance of the contract and on which the customer may regularly rely), liability is limited to the foreseeable damage typical for this type of contract. Otherwise liability for slight negligence is excluded. For loss of data, the provider is liable in cases of slight negligence only for the effort that would have been needed to restore the data had the customer made regular backups appropriate to the risk. Statutory liability remains unaffected otherwise.
14. Data protection
See the privacy policy. For customers who process personal data of third parties in their instance, a data processing agreement is available on request to support@envbay.com.
15. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection law of the customer’s country of residence remains unaffected. Jurisdiction for merchants, legal entities under public law and special funds under public law is Plauen, Germany. The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Should a provision be invalid, the remaining provisions stay in force.
